Just so you know..... My question is is this involving are F-250 and 350 being there Commercial trucks too??? Something to ponder. :coffee

Commercial drivers “ringing in the New Year” could be in trouble if they answer a ringing cell phone while driving.

The U.S. Department of Transportation (DOT) has set January 3, 2012, as the effective date of the new hand-held cell-phone ban that was announced in late November and published in the Federal Register on December 2, 2011.

The rule — issued jointly by the Federal Motor Carrier Safety Administration (FMCSA) and the Pipeline and Hazardous Materials Safety Administration (PHMSA) — prohibits interstate commercial motor vehicle (CMV) drivers from using hand-held cell phones while driving. For intrastate drivers, the ban only applies to those hauling hazardous materials for now, but the states are expected to apply the ban to all in-state commercial drivers in coming years.

Under the new rule, CMV drivers will not be able to hold, dial, or reach for a hand-held cell phone, including those with push-to-talk capability. Hands-free phone use is allowed, as is the use of CB radios and two-way radios.

Specifically, the rule prohibits drivers from:

•Using at least one hand to hold a mobile phone to conduct a voice communication;
•Dialing or answering a mobile phone by pressing more than a single button, and
•Reaching for a mobile phone in a manner that requires the driver to maneuver so that he or she is no longer in a seated, belted, driving position.
Drivers will not be able to use hand-held phones while temporarily stopped due to traffic, a traffic control device, or other momentary delays, but they will be able to use them after moving the vehicle to the side of, or off, the highway and stopping in a safe location.

Drivers who violate the new ban will face federal civil penalties of up to $2,750 for each offense and disqualification for multiple offenses. Companies that allow their drivers to use hand-held cell phones while driving will face a maximum penalty of $11,000.

In September 2010, the FMCSA issued a regulation banning text messaging while driving a CMV and PHMSA followed with a companion regulation in February 2011, banning texting by intrastate hazardous materials drivers.

ENFORCMENT is the issue.

A young lady passed me last week.. Had one Cell held to her ear with her shoulder.. texting on another Cell.. driving with her elbows. @ 70+ mph, on I-5, in traffic :eek::eek:

Not the First time I've seen that either. :(

What NEEDS to happen is: The First Time FINE needs to be in the 4 Digit range. Nation Wide !!! Across the Board.

Commercial, Non-Commercial.. this whole Cell Phone use thing, while driving.. is get'n outa hand. (no pun)

Dogman's article refers to those drivers (commercial) that are paid to drive. It does not refer to F-250/F-350 drivers unless they are part of a commercial paid to drive job. I should add that we citizen drivers have our hands tied enough.

The other thing is. You have a business, your business name is on your truck. The truck is in your name with your commercial tag, not your companies.

There was a piece on the ABC news tonight.. About a TOTAL ban, Nation Wide, in the works at the Federal level (NTSB) about Cell Phone/electronic device use while driving, with hefty, hefty fines and other actions against those who are caught.

We'll see. Hope Something happens.

Being a strong proponent of individual and state rights, this does not sit well with me. I where a seatbelt and helmet out of choice, not becuase some bueracrat caved in to an insurance lobbyist and made a law :rant. Make no mistake, the seatbelt and helmet laws are NOT for individual safety, but protecting insurance company interests. This one is no different.

I'm sick and tired of laws like this. I can drive and talk on the phone just fine. An occasional text here and there too. I am a responsible person and know how to operate safely. I also understand a long forgotten concept. DEFENSIVE DRIVING. If I see a distracted driver, I avoid them. I watch my rearview when coming to a stop or making a turn. The thing is stupid people will always find something else stupid to do! :bp

I absolutely agree with both of you guys. I'm also tired of laws, laws, laws. Laws infringing on our Basic Freedoms & Rights.

I also use Defencive Driving, and Situation awareness.



But anymore, the Cell Phone use thing is getting Insane. You just can't be Defencive, or Aware ENOUGH..when almost everyone, anymore, is Talking, Tex-ting, Emailing and searching the Internet.. while they're behind the wheel.

I hate to see another damn law too.. but it's going to take some sort of intervention, at some point, to get a handle on it.

We were recently rear-ended, first thing outa the guys mouth was: Sorry, I was on my Cell.. didn't see the light changing... you two Okay ? He addmited full responcibility to the CHP, and the Cell coversation being the cause too.

So i'm probably a bit more receptive to Something being done.
