That might be the case. But there is an enforcability issue. If a person finds that his warranty claim has been unjustly denied, who does he report it to? The police? Yea right!!
The only recourse a person has is to hire a lawyer and take the manufacturer to court. The manufacturers have an army of lawyers who's job is to tie up Magnuson Moss suits in the courts as long as possible and make them as expensive as possible for the plaintiff. That is why a it costs $10,000+ in legal fees to get the manufacturer to honor a $3,000 transmission warranty repair.
That is why Magnuson-Moss is useless and always will be.
