Here's the short version:
3.5 months ago my wife had a baby, she was driving a 02 mustang gt 5sp, etc, which she loooooved. Mustang + baby = PITB. So we traded it at the local ford dealer, for an 02 montero limited w/31k. It was NICE, everthing but the kitchen sink.
3.5 mo. and 3K later we hate it. Evasive manevers are impossble, poor braking etc, etc. She doesn't feel safe.
We went back to them and test drove a magnum, and liked the magnum, just not that one-it was a rental.
We went to a different dealer in a different town 50 miles away, and found a 1 owner, w/ all the bells and whistles, fewer miles ,for just a little more $.
When we started taking $, they ran a carfax on our montero, and it showed 2 collisions, 1 'moderate to severe' in the front, and 1 'slight to moderate' in the rear. There was no airbag deployment. Thus their offer was WAAAAY low, over 5k less than we paid.
Are dealerships required to disclose collisions, damage, etc, anything that would severely depreciate the value in this short of time?
We feel taken advantage of:nutkick:, now we have a vehicle that we hate, feel unsafe in, and can't afford to pay any more $. It was a big enough hit on the wallet the 1st time.
My wife talked w/ the owner of dealer #1 today, and he tried to snake out of everything, but she held her ground. He said that he would find us a magnum the color she wanted, and 'try to do his best to make us happy, and keep us as customers.' I don't want to be his customer, and I don't want a previously enjoyed rental car. They broke it off in us once, that's enough.
What can I do, who do I talk to?

dealers dont "have" to disclose prior accident damages but if your state has the salvage title laws it should say "reconstructed, prior collision".check with your local DMV about that.you may also be able to do something about it under the lemon laws.keep bringing it back saying that it doesnt handle right.after a certain amount of attempts to solve the problem they are required to buy it back or replace it.i dont think there is anything a lawyer could do for you, unless the title isnt a salvage title and it should be or the dealer is required by the laws in your state to disclose prior accident damages.

aint that a weird one.
we are asked to sign a statement when we trade in at the dealer about wrecks and such, but dealers are pretty much protected by waves of lawyers :D
i think the ask first and see it in writing is our only protection...
sorry to hear you got a not so good "rising Sun" car/suv

It is a clean title. My wife took it to our body shop, and had a 3rd party look at the damage, and he had to look really hard to spot the damage, and complimented whoever did the repair.
There are many other reasons why my wife doesn't like the montero. Which is why we are wanting to get rid of it. When we went to dealer #2, they carfaxed it and that is when we found out about the prior damage.
