I am writing an article for the Texas Bar Journal and need a word --

I am discussing the result of an action in bankruptcy and am trying to pose the question "to whose benefit does the cause of action XXXX?" I need a word to cover those X's. Words that are not useable -- arise, accrue, etc.

I thought it might be inure but that is apparently not right either.

Suggestions? It doesnt need to be a legal word, just something like, but not, "arise".

Thanks!

Peter

Maybe this??? A word switch?:dunno

"Whom does the cause of this action benefit"

yeah, that might work. I'll play around with it and see how it sounds.

Thanks!

(just for my own benefit, I'll take more suggestions too).

It might help having more of the sentence for context.:sweet

I started to but thought it might require too much explanation - what is to the creditor's benefit isnt really a cause of action but the result.

A bankruptcy trustee is suing the corporate debtor to reach past the corporation and grab assets owned by the directors or sole-shareholders (piercing a corporate veil). You can only do this if you have some other substantive cause of action that is ultimately successful and then you still have to prove more stuff in order to "pierce". (are you still awake?)

The thing I am trying to discuss is, which bankruptcy creditor gets a benefit from successfully piercing? (Because I know you are just riveted to your seat, the answer is all of them).

Now that I have probably bored everyone on the site to sleep...

Thanks for input!

I'd go with word swapping if you want to keep that sentence however simply stating that though the corperate veil is peirced by one creditor the benefits are reaped by all creditors.

I'd go with simply "who does this action benefit" or "who benefits from this action"

yeah, I htink word swapping will take care of it. It's just a rough draft right now.

Thanks for the suggestions.
